Welcome to ClientComm ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the ClientComm website, mobile applications, and services (collectively, the "Service").

5. Twilio Integration

The Service integrates with Twilio to provide SMS messaging capabilities. By using the Twilio integration, you agree to comply with Twilio's Terms of Service and Acceptable Use Policy, which can be found at https://www.twilio.com/legal/tos.

You are responsible for ensuring that your use of the Twilio integration complies with all applicable laws and regulations, including those related to SMS messaging and telemarketing.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by ClientComm and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material on the Service without our prior written consent.

7. User Content

You retain all rights to any content you submit, post, or display on or through the Service ("User Content"). By submitting, posting, or displaying User Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with providing the Service.

You represent and warrant that you own or have the necessary rights to all User Content you submit and that such User Content does not violate any third party's intellectual property rights or other rights.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

IN NO EVENT WILL WE, OUR AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

You agree to indemnify, defend, and hold harmless ClientComm and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

14. Governing Law

These Terms and your use of the Service will be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule.

15. Changes to Terms

We may revise these Terms at any time by posting the revised Terms on the Service. Your continued use of the Service after the posting of revised Terms means that you accept and agree to the revised Terms.
